1. About This Agreement
These Terms of Service govern your use of the Shockwave Economy Intelligence platform, website, subscription service, and digital publications (collectively, “the Platform”) operated by ProcessIQ (Pty) Ltd (“we,” “us”), trading as Shockwave Economy Intelligence. By accessing the Platform or purchasing any product, you accept these Terms in full.
2. The Platform and What We Offer
We publish original practitioner intelligence reports, a monthly brief, and analytical frameworks on supply chain disruption, resilience, and risk management. Content is delivered digitally. Nothing on the Platform constitutes financial, legal, or investment advice.
3. Subscriptions and Purchases
- Annual and monthly subscriptions renew automatically unless cancelled before the renewal date.
- Individual report purchases are one-time transactions granting a non-transferable, non-exclusive licence to access and use the relevant publication.
- Pricing is displayed in USD. All transactions are processed by Paddle as Merchant of Record; Paddle’s own terms apply to the payment transaction.
- Access to subscription content is conditional on maintaining an active, paid subscription.
4. Cancellation
You may cancel a subscription at any time via your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. You retain access until that date. No partial-period refunds are issued on cancellation except where required by applicable law or our Refund Policy.
5. Intellectual Property
All content published on the Platform, including the Shockwave Economy framework, the Certainty Premium, the Reactive Gap, the Three Futures Framework, and Resilience Architecture, is the original intellectual property of Dr Ernst H. B. van Biljon and is protected by copyright. ProcessIQ (Pty) Ltd is authorised to publish and commercialise this content under licence. You may not reproduce, distribute, adapt, or resell any content without prior written consent. Sharing login credentials or distributing report files to third parties is prohibited.
6. Acceptable Use
You agree not to: use the Platform for any unlawful purpose; attempt to gain unauthorised access to any part of the Platform; scrape, harvest, or systematically download content; or misrepresent the origin of any content derived from the Platform.
7. Disclaimer and Limitation of Liability
The Platform provides analytical intelligence for informational purposes. We make no warranty that content is complete, error-free, or applicable to your specific circumstances. To the maximum extent permitted by law, our total liability for any claim arising from use of the Platform is limited to the amount you paid us in the three months preceding the claim. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
8. Governing Law
These Terms are governed by the laws of the Republic of South Africa, except where mandatory consumer protection laws in the subscriber’s country of residence confer rights that cannot be lawfully excluded or limited, in which case those mandatory rights apply. Subject to the foregoing, disputes shall be subject to the jurisdiction of the South African courts.
9. Changes to These Terms
We may update these Terms. Material changes will be communicated by email or prominent notice on the website. Continued use after the effective date of any update constitutes acceptance. Questions: info@shockwaveeconomy.com
